TERMS AND CONDITIONS OF SALE

Article 1 – Purpose and Scope

These Terms and Conditions of Sale govern the sale of products on euroeclipseglasses.com between the seller (hereinafter referred to as the “Seller”) and any consumer customer (hereinafter referred to as the “Customer”). Placing an order implies full and unconditional acceptance of these Terms and Conditions.

Article 2 – Seller Identification

Article 3 – Products

The products offered are solar viewing glasses (eclipse glasses) compliant with EN ISO 12312-2:2015 and Regulation (EU) 2016/425 concerning personal protective equipment. Products are presented as accurately as possible; photographs and descriptions are not contractually binding. Products comply with current French legislation.

Article 4 – Prices

Prices are indicated in euros (€), all taxes included. As the Seller benefits from the VAT exemption regime, VAT is not applicable pursuant to Article 293 B of the French General Tax Code, and no VAT is charged. Shipping costs, if applicable, are displayed before order confirmation. The applicable price is the one in force at the time the order is placed.

Article 5 – Orders

Orders are placed directly through the website. The sale is considered concluded once the order has been confirmed and payment has been received. An order confirmation is sent by email.

Article 6 – Payment

Payment is made online using the methods offered on the website. Transactions are secure. Orders are processed only after payment has been successfully received.

Article 7 – Delivery

Products are shipped from France to the address provided by the Customer. Delivery times and shipping costs are specified during checkout. The Seller shall not be held liable for delays caused by the carrier or force majeure. In the event of damaged products upon delivery, the Customer is invited to notify contact@euroeclipseglasses.com without delay.

Article 8 – Right of Withdrawal

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has fourteen (14) days from receipt of the products to exercise the right of withdrawal without providing any reason. To do so, the Customer must notify the Seller through an unambiguous statement (email to contact@euroeclipseglasses.com). Products must be returned in their original condition, and return shipping costs are borne by the Customer. Refunds are issued within 14 days following receipt of the returned products or proof of shipment.

Article 9 – Legal Guarantees

The Customer benefits from the legal guarantee of conformity (Articles L.217-3 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code). The Customer may obtain repair or replacement of non-conforming goods or, failing that, a price reduction or cancellation of the sale, under the conditions provided by law.

Article 10 – Safety and Liability

Eclipse glasses are eye protection devices intended for direct observation of the Sun. The Customer agrees to strictly follow the safety instructions supplied with the product, including inspecting the glasses before each use and refraining from using them if scratched, punctured, or damaged; never using them with binoculars, telescopes, cameras, or other optical devices; and supervising children during observation. The Seller provides products compliant with applicable standards and shall not be held liable for damage resulting from improper use or from the use of damaged products. The Seller's liability is limited to the extent provided by law.

Article 11 – Personal Data

The Customer's personal data is processed in accordance with the website's Privacy Policy and the General Data Protection Regulation (GDPR).

Article 12 – Complaints and Consumer Mediation

Any complaint may be sent to contact@euroeclipseglasses.com.

In accordance with Articles L.612-1 and following of the French Consumer Code, if a written complaint has not been resolved satisfactorily, the Customer may, free of charge, refer the matter to the consumer mediator designated by the Seller:

For cross-border disputes within the European Union, the Customer may obtain information through the European Commission's consumer redress portal (consumer-redress.ec.europa.eu) or contact the European Consumer Centre (ECC France).

These Terms and Conditions are governed by French law. In the event of a dispute, and after seeking an amicable resolution, French courts shall have jurisdiction in accordance with applicable law.

These Terms and Conditions are governed by French law. In the event of a dispute, and after attempting to reach an amicable settlement, French courts shall have jurisdiction in accordance with ordinary legal provisions.
